The case concerned the CBS television network's appeal of a 50,000 fine levied by the Federal Communications Commission for a performance by Janet Jackson and Justin Timberlake during CBS' coverage of the 2004 Super Bowl that involved partial nudity. This was the second time the Third Circuit heard this case. The U.S. Supreme Court declined to hear an appeal of the case but sent it back to the Third Circuit to be reviewed in light of the Supreme Court ruling on "fleeting expletives" in FCC v.
